General terms and conditions of business
§ 1: Registration: Registration is done in writing, verbally or online. Registration is always binding. Registration is valid as soon as it has been confirmed by the ski and snowboard school. Confirmation of registration does not require any special form.
§ 2: Number of participants: Group courses are held with a minimum of 4 participants. If there are fewer participants, the ski and snowboard school is entitled to increase the course price per person or shorten the course time.
§ 3: Lift transport fees: The course fee does not include the lift transport fee.
§ 4: Cancellation of courses: Only the ski and snowboard school is entitled to cancel a course (e.g. in the event of bad weather or if booked online within 24 hours). In these cases, course fees will be refunded. The participant is not entitled to claim damages.
§ 5: Payment: Course and rental fees are paid in cash or by EC card on site before the course begins or online during the online booking process. The amount of the fees is stated in the brochure or on the Internet.
§ 6: Course cancellation and refund: Course cancellations due to force majeure will result in an appropriate partial refund. The same applies if the participant is obviously injured or ill. The ski and snowboard school can request a medical certificate for this purpose. Cancellation of the course due to misconduct by the participant will not result in a refund.
§ 7: Cancellation and cancellation fee for online registration: A cancellation of the contract when booking a group course is possible up to 48 hours before the start of the course. Withdrawal from the contract when booking a private course is possible up to 7 days before the start of the course at the latest. If the cancellation is made at a later date, the ski and snowboard school is entitled to charge the full agreed rate as a cancellation fee. The course fees can be partially refunded upon presentation of a medical certificate.
§ 8: Content of the online offer: The ski and snowboard school assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against the ski and snowboard school, which refer to damages of a material or immaterial nature caused by the use or non-use of the information provided or by the use of incorrect and incomplete information, are fundamentally excluded, unless the ski and snowboard school can be proven to have acted intentionally or with gross negligence.
All offers are non-binding and subject to change. The ski and snowboard school reserves the express right to change, add to or delete parts of the pages or the entire offer, or to temporarily or permanently stop publication thereof without prior notice.
§ 9: Liability: The ski and snowboard school is not liable for damage to property or accidents suffered by participants during the course. Participants are directly liable to the injured party for any damage caused. Taking out accident, health and liability insurance is mandatory.
§ 10: Place of performance, legal status and place of jurisdiction: The place of performance is 87541 Oberjoch. The parties agree to the application of German law. For all disputes in connection with the present contractual relationship, the exclusive jurisdiction of the court with jurisdiction for Oberjoch is agreed.
Terms and Conditions for Rental Items
The following conditions are an integral part of the present loan agreement.
The renter bears full responsibility for the rental object.
During the rental process, the insurance sum of 10% of the rental amount is automatically added. This means that the lessor assumes 100% of the risk of breakage and damage.
In case of cancellation of online bookings, the landlord reserves the right to retain a processing fee of 10% of the rental amount.
In case of loss of the rental object due to theft, the renter will be charged the market value of the rental object.
If the material is damaged improperly, the tenant will be charged for the repair according to the valid price list.
The rental item can be exchanged for equivalent items at any time during the contract period. It can also be exchanged for items in higher categories at any time for an additional charge.
The rental equipment must be paid for each day until it is returned, the latest return date is 10:00 a.m. the following day.
In the event that the rented equipment is not returned properly for whatever reason, the lessor will automatically file a complaint for theft against the renter after 30 days.
A regular rental contract is required for the assembly, repair and adjustment of a ski binding. By signing this contract, you agree to the professional adjustment of the bindings according to the manufacturer's instructions and accept the regulations and rental conditions.
It is only possible to conclude a rental agreement with an identity card.
